This weeks I was inundated with calls from new clients asking about credit card lawsuits they recently received, and asking what could be done.  Some even received garnishment notices, where their paychecks were already being garnished, without notice to them.  This is both illegal and easy to fight.

One option to cancel credit card debt is settlement.  A settlement of credit card debt requires first ascertaining that the amount being charged is correct, and then negotiating down the balance, including forgiveness and then payment to cancel the balance.  Many credit card companies threaten suit or jail and often do not even have correct balances. That is why it is of utmost importance to make sure the starting number is accurate.

Another option to cancel credit card debt is a payment plan, again reducing the starting balance, and then agreeing to payoff the short balance within 12 or 24 months.

Once a credit card suit is filed, or worse, a judgment is entered against  you for the debt owed, the creditor can now freeze your bank accounts,  repossess a  car, or garnishment your wages.  Often, creditors who hire attorneys do not even properly serve defendants with the credit card debt lawsuit, causing the debtor o not even know a suit is filed against them until its too late. This is both illegal and unconstitutional and the judgment can be vacated and dismissed.
