SOUTH FLORIDA LANDLORD TENANT LAWYERS

As a landlord, are you aware that under Florida Statutes Chapter 83.49,  you are required to provide your tenant with a written notice, within 30 days of entering the lease, advising where the deposit is held, the banking institution and the name of the account?  Are you aware that if this is not done, then you are required to return the security deposit to the Tenant and can not keep it to satisfy any damages caused by the Tenant?

This is a harsh law that protects tenants to make sure the funds that are advanced by the tenant, are held secure and are not commingled with other funds of the Landlord. And the courts are strict about this.

Next time you are about to enter into a landlord tenant residential lease, it is best to contact an attorney to assist with contract review and preparation if required, and to guide and counsel you so you are protected every step of the way.

We are a full service real estate law firm handling all aspects of contract and landlord tenant law.

SOUTH FLORIDA REAL ESTATE LAWYERS

Are you purchasing from a development or Developer in South Florida?  Many developer real estate contracts provide for a
developer “credit” at closing or incentives when you close with their title company and “preferred” lender.  However, what many innocent buyers of real estate do not know is that while the developer does honor the credit, you are actually paying more in the long run, on processing fees, settlement fees, and even paying their attorney.  Resulting in no actual savings but rather an overpayment.

Many buyers of developments do not know that they have the right to elect their own attorney and even have an attorney represent them at closing.  Our role as your real estate attorney when purchasing from a developer is not only to overlook the entire transaction, including all the contractual terms, but also to make sure the proper charges and credits are given at closing.  We check the title to  make sure that it is free and clear and are present during the closing to make sure the closing documents you are required to sign are proper.

When purchasing from a developer, do not go it alone.  Always use the services of a competent real estate attorney, and  allow the Real Estate Law Firm of Jacqueline A. Salcines to guide you.

We are a full service title company and handle closings from beginning to end.

ESCROW DEPOSITS HELD IN TRUST

Are you purchasing real estate in Florida?  Selling real estate in Florida? Are you about to enter into a real estate contract and relying on your realtor to hold your escrow deposit? Cases of escrow deposit comingling or fraud are on the rise.  Escrow agents in Florida hold a fiduciary duty to the buyer or seller to hold escrow deposits on real estate contracts in a special account, not comingled with personal funds, until the conclusion of the real estate transaction.  In my firm, when I represent sellers, I always have the escrow deposit held in my firm’s trust account, to guarantee that the escrow deposits are in fact made, are held during the pendency of the real estate closing, and disbursed correctly at the time of closing.

As a buyer, you want to make sure your escrow deposit is safe and not in the hands of someone that could use the funds and commit theft or fraud.

Whether you are about to sign a contract and need an Escrow Agent or require the services of a competent, real estate attorney,  allow the Real Estate Law Firm of Jacqueline A. Salcines to guide you.

We are a full service title company and handle closings from beginning to end, including the safekeeping of your escrow deposit.

LANDLORD TENANT LAW

Mold is a recurring issue in South Florida, specially  during the summer months.

New Florida Bar forms in residential landlord tenant leases now include mold waivers, which require the tenant to inspect the property and consent to its condition prior to moving in and allows the Landlord to be off the hook if mold arises during the landlord tenant relationship.  While not all mold is dangerous to our health, mold can cause severe property damage with spores attaching to clothes and furniture.  One recent mold case handled by our firm resulted in severe asthma and emphysema symptoms to the tenants minor child, resulting in thousand in medical bills, hotel bills and long term care.

Florida landlord tenant law is governed by Florida Statutes Chapter 83.  Chapter 83 makes the landlord responsible for providing habitable conditions in a property rented. This means air, water and conditions that do not cause health concerns. However, if you are one of the many tenants that signed these mold riders to the residential  lease agreement, you may have permitted the landlord to escape liability since the landlord can say it was the tenants failure to maintain the air conditioner or the water conditions in the property.

Mold issues that arise during a landlord tenant residency must be communicated in writing to the landlord and allow the landlord 7 days to remediate the problem. This  could mean calling a mold remediation company to assess the existence of mold, type of mold and remove it. Since  mold spreads quickly when the conditions (humidity, lack of air flow, dark damp growing conditions), it is crucial to address it immediately when it is first visible.

If you suspect you have mold in your real estate property, call attorney Jacqueline Salcines right away.  Often if handled from the beginning, there are no delays and the issue can be resolved immediately.  We can review your lease at no cost to you and advise what is the best course of action.

At the Law Offices of Jacqueline A. Salcines, PA we have been representing landlords and tenants for over 17 years.  We are knowledgeable in all aspects of landlord tenant law and ready to assist you with your needs. Call today at (305) 669-5280 to schedule your legal consultation.

LANDLORD TENANT LAW

Whether you are a tenant in South Florida housing that is experiencing mold, or a landlord in South Florida being told by your tenant that the property has mold, the solution is not always easy.  Living in such close proximity to the water, it is almost impossible to not find a property in South Florida that does not have the presence of mold. And not all mold is dangerous, life threatening or hazardous.  However, some mold is and that is where things can get very scary.

Florida landlord tenant law is governed by Florida Statutes Chapter 83.  Chapter 83 makes the landlord responsible for providing habitable conditions in a property rented. This means air, water and conditions that do not cause health concerns. However, many residential leases contain clauses that opt out of Florida landlord tenant law Chapter 83, and the tenant signs that he accepts the property as is and that at the time of signing there is no  mold.

Many residential landlord tenant leases also require notice to the landlord and opportunity to correct the issue, which could mean calling a mold remediation company to assess the existence of mold, type of mold and remove it.  Mold also causes severe property damages when spores attach to sofas, and clothing, aggravating the situation and out of pocket damages even more.

If you suspect you have mold in your real estate property, call an attorney right away.  Often if handled from the beginning, there are no delays and the issue can be resolved immediately.  We can review your lease at no cost to you and advise what is the best course of action.

SOUTH FLORIDA REAL ESTATE LAWYER

TITLE SERVICES – TITLE COMPANY

Buyers and seller alike should always hire an attorney to represent them and their interests for a real estate closing and real estate transaction. Whether you are buying in Miami Dade County and require the title company to represent you, examine the property title, and prepare a title commitment, or you are a seller of real estate and require not only contract review and revisions, but assistance with document preparation, you must always hire an attorney.

While many states only allow real estate attorneys  to conduct real estate closings, Florida is not one of them. Therefore, many sellers opt to use the title company selected by the buyer in order to represent them. However, that opposing party title company does not represent you. They will charge a fee for document preparation, or settlement services, but at the end of the day, if there is an issue, you are on  your own.

Seller services can include contract preparation, contract review, addendums, inspections negotiations for credits, and a host of different documents required whether the seller is a trust, or a company. There are also issues relating to death of the title holder or liens on the property.

As a buyer,  the title company will also help with contract preparation or review, run title, run lien searches and prepare closing statements.

While no two real estate transactions are ever alike, no matter whether you are on the seller side or the buyer side, do not go it alone.

At the Law Offices of Jacqueline A. Salcines, P.A. we have been assisting foreigners, both buyers and sellers, with their real estate needs since 1999.  We are a full service title company and extremely knowledgeable in FIRPTA rules and regulations.

Whether you are buying, selling or refinancing, we will handle all of the details and represent you from contract to closing.

SOUTH FLORIDA REAL ESTATE LAWYER

According to the National Association of Realtors, pending home sales in Florida is down by 1.3 percent for the month of April.  This is a decline from sales last  year for the same given time.  Despite the decline however, prices remain constant, up from last year at this time.  Pending real estate home sales may be down due to strengthening of the U.S. Dollar, making some property unaffordable to buyers.  The South Florida real estate market has also experienced a dramatic rise in condominium developments, signaling a higher volume of inventory, driving some prices down.

Mortgage rates for real estate purchases continue to be at an all time low, but certified appraisals are also at an all time low, signaling delays in closings as well.

SOUTH FLORIDA REAL ESTATE LAWYER

The U.S. real estate market, particularly South Florida, while always bolstered by international homebuyers, is expected to be predominantly driven by international buyers in the coming years.  Foreigners or home buyers who are neither U.S. Citizens or permanent residents, are expected to increase sales and rents of homes in the United States.

The majority of foreign buyers are from China, topping Canada from last year.  The bulk of future home purchases are being made in Florida with 22 percent, California with 15 percent and Texas with 10 percent.  Source: National Association of Realtors.

Foreigners find the United States and U.S. real estate a great place to invest, specially with countries where the political arena is unstable or in an uproar, like Venezuela and Panama.

At the Law Offices of Jacqueline A. Salcines, P.A. we have been assisting foreigners, both buyers and sellers, with their real estate needs since 1999.  We are a full service title company and extremely knowledgeable in FIRPTA rules and regulations.

SOUTH FLORIDA REAL ESTATE LAWYERS

FIRPTA law, which stands for the Foreign Investment Real Property Tax Act, recently changed last year, increasing the withholding from 10% to 15%.  Many foreign sellers who enter into Residential real estate contracts, are not aware of this FIRPTA withholding requirement.  Foreign sellers believe that because they don’t pay federal income taxes in the United States, then they are immune from declaring any profits on real estate sales transactions or filing tax returns. This is false.

Any seller of real estate is required to disclose the sale to the Internal Revenue Service and if a foreigner, then 15% of the gross sales price will be withheld at the time of closing and remitted to the Internal Revenue Service.

Additional forms are then required to be filled out and sent to the IRS and eventually a tax return which if the amount of tax on the sale is less, the FIRPTA withholding difference is then refunded.

There are numerous exemptions to FIRPTA withholding requirements, for example if the sales prices is less then $300,000.00, if the buyer is going to live in the property, and countless others.

However many title companies and even attorneys are not familiar with exemptions and retain the funds regardless.

At the Law Jacqueline A. Salcines, PA., we have over 17 years experience assisting buyers of real estate and sellers, with their real estate needs.  Attorney Jacqueline Salcines is not only a real estate attorney but also an accountant and able to provide advice regarding FIRPTA and other tax issues.
