Are your Solar Panels not working? Did the solar company commit fraud when they sold the panels to you and are now bankrupt?
A solar agreement can stand between you and a successful home sale. The payoff may be unexpectedly high, the buyer may be unsure about assuming the agreement, or the circumstances surrounding the solar company’s sale may raise questions about whether the contract was properly obtained.
At SalcinesLaw, we help sellers investigate solar agreements and develop a strategy to address them before they disrupt a real estate transaction.
- We investigate how the solar agreement was sold
We review the contract and related records, including sales materials, financing documents, payment history, payoff statements, and communications with the solar company. We look at what the seller was told, what the documents say, and whether the company’s conduct may have violated applicable law.
Depending on the facts, our review may consider laws such as the Florida Deceptive and Unfair Trade Practices Act, section 501.204, Florida Statutes, or the Federal Trade Commission Act, section 5, 15 U.S.C. § 45, which addresses unfair or deceptive acts or practices. These laws do not automatically cancel a solar contract; the specific facts and legal requirements matter.
- We use our 16-point questionnaire to develop a strategy
Our 16-point solar questionnaire helps us identify potential issues and grounds to challenge or cancel an agreement. During a strategy session, we review the answers alongside the contract and supporting documents, assess what additional evidence may be needed, and determine how to approach the solar company.
If the facts support a legal basis to challenge the agreement, we can pursue termination and seek cancellation of sums claimed to be due. Whether those remedies are available depends on the contract, evidence, and applicable law.
- We negotiate a solution that may work for the sale
If cancellation is not available or does not resolve the issue, we can contact the solar company to determine whether the buyer may assume the agreement. We can also negotiate the payoff or other sums owed, with the goal of reaching an amount the seller and buyer can address as part of the transaction.
Starting early gives us more time to investigate, negotiate, and coordinate with the seller’s real estate team before closing deadlines become urgent.
Get legal help before the solar issue threatens your sale
If you are selling a Florida home with solar panels, contact SalcinesLaw to discuss a review of your agreement. We can assess potential violations, use our 16-point questionnaire during a strategy session, pursue cancellation where the facts and law support it, and negotiate an assumption or reduced payoff where appropriate.
This article provides general information and is not legal advice. The availability of cancellation or debt relief depends on the specific agreement, evidence, and applicable law.
The most expensive closing is the one without a lawyer.
