CANCELLATION OF A TIMESHARE CONTRACT – VACATION RENTAL CONTRACT

Time share presentations, while you are eating free food and being pampered with champagne, is all great. However, when the monthly bills start arriving for a property that you only have a week or two use of, the deal does not sound so great anymore.  Often,  innocent trusting consumers and my clients, enter into these timeshare agreements or vacation rental agreements, not knowing what they are getting into.  Timeshare agreements are promissory notes with a promise to pay a said sum for often ten or fifteen years, with limited use.  Representatives often tell consumers that the timeshare agreements can be cancelled down the line, which is false and misleading. Yet many borrowers innocently sign and then pay the price.

Although the timeshare agreements state that they can not be cancelled, often it takes a good negotiator to present the facts so that the timeshare representatives understand and agree not only to cancel the timeshare agreement but also to refund any monies paid.

In my firm, these unconscionable timeshare agreements are appearing more and more often. Clients call, often from abroad, to state they have no idea what they signed, or the ramifications of the agreements and Notes.  We have been successful in cancelling these timeshares for clients and are able to get borrowers out of these timeshare agreements.
